Nothing incenses me more about the Obama administration than the (1) failure to close Guantanamo and (2) this week's executive order for indefinite detention of several detainees. IMO, these men ought to have been tried long ago, and in the absence of speedy trial, ought to have been released.
There are two main reasons why they are not tried.
1. They were subjected to kidnapping, torture, and duress. In one trial so far, the AG did an end run that allowed no evidence to be presented about torture and ill-treatment. That is not possible for Khalil Sheikh Mohammed. Basically the government has to bury him in order to not reveal embarassing and criminal details about the conduct of the U.S. government and employees.
2. The government has lost the damned paperwork or has based its case on matters that cannot pass muster under the rules of evidence.
I would like to see a groupof right-minded Americans load up speedboats with guns and explosive and set out to spring these men, that are illegally held, and destroy the Guantanamo facility. Whatever the prisoners have done is irrelevant. The U.S. Constitution controls the situation and all these Bushanigans and now Obamakins cannot change that. Bring them to trial or free them. FREE THE POLITICAL PRISONERS HELD IN GULAG GUANTANAMO!
